Terms of service
This page is a template. The operator of this instance replaces every part in square brackets before going live, and has it checked if in doubt.
Last updated: [Date]. The German version of these terms is the legally binding one.
#1. Scope
These terms apply to the use of Roleplay+ Tickets: the Discord bot, the website and the dashboard. The provider is [Company name, address], "we" below. Users are people who add the bot to a Discord server, use the dashboard or buy Premium.
#2. Services
We provide the bot and the dashboard as a hosted service. There are two plans:
- Free: free of charge with no time limit, with the features and limits named on the pricing page.
- Premium: paid, applies to one Discord server at a time and extends features and limits as described on the pricing page.
We keep developing the service and may change features if the core of the service remains and the change is reasonable for you. The service depends on Discord. Changes to or outages of Discord are beyond our control.
#3. Conclusion of contract
The contract for Free is concluded when you add the bot to a server or sign in to the dashboard. The contract for Premium is concluded when you complete the checkout in the dashboard.
#4. Prices and payment
The prices on the pricing page at the time of ordering apply. [State whether prices include statutory VAT.] Premium is billed in advance for the chosen period, monthly or yearly, through the payment service Stripe.
#5. Term and cancellation
Premium renews automatically for the chosen period unless cancelled before. You can cancel at any time in the dashboard, effective at the end of the current period. You can end Free at any time by removing the bot from the server. The right to terminate for good cause remains unaffected.
#6. Right of withdrawal
[For consumers, insert the withdrawal notice with the model withdrawal form, including the rules on the early expiry of the right of withdrawal for digital services.]
#7. After Premium ends
When Premium ends, the server uses the Free behaviour. Stored settings remain and apply again when the server gets Premium again. Saved transcripts keep their expiry date.
#8. Your obligations
You follow Discord's terms and applicable law. You are responsible for content in tickets, messages and custom commands on your server. You tell the members of your server that a ticket bot processes data there. You do not use the service to disrupt it, overload it or get around security measures.
In case of serious or repeated violations we may block access for a server.
#9. Availability
We aim for smooth operation but do not owe a specific availability. We announce maintenance in advance where possible.
#10. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act. For slight negligence we are only liable for breaches of essential contractual obligations, limited to the foreseeable, typical damage. Liability is otherwise excluded.
#11. Data protection
How we process personal data is described in the privacy policy.
#12. Changes to these terms
We may change these terms with effect for the future. We inform you at least [six weeks] in advance. If you do not object before they take effect, the new terms apply. The notice explains your right to object and its consequences.
#13. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection rules of the country you live in remain unaffected. If the user is a merchant, the place of jurisdiction is [City]. If a provision is invalid, the others remain valid.
